Compliance
AI calls and texts to US consumers are regulated. Avoonta enforces the rules it can check. The rest depends on you, because only you know how each lead was collected.
This page explains how Avoonta behaves and what it expects from you. It is not legal advice. Ask your own lawyer what your business needs.
Consent
What we enforce
- Every order needs a
consentobject withopt_in_confirmed: trueand aconsented_attime with a time zone. Without it the order is refused with400 consent_requiredbefore anything else is checked. See Orders. consented_atcannot be more than 5 minutes in the future or more than 1,461 days old.- The consent record is stored with the order for good and can never be edited. It covers every call and text of that order.
- Leads from the trigger URL are accepted only after a workspace owner or admin attests that every lead sent to it agreed to be called and texted by the business, including by an AI assistant. That attestation (who, when, exact words) is stored on every lead's record.
What you must do
- Only send leads who agreed to be called and texted by your business, including by an AI or automated voice. Make sure the wording the lead agreed to says so.
- Send the real time the lead agreed in
consented_at, not the time you call the API. - Send where they agreed in
consent.source(the form URL, the ad, the campaign). It is optional for the API, but it is your evidence. - Keep your own copy of the consent: the form, the exact wording shown, the time and the lead's details.
- Never send purchased lists, scraped numbers or leads who agreed to be contacted by someone else.
AI disclosure (locked)
Every call, outbound and inbound, starts with a fixed line that says the agent is an AI assistant and names your business. It is spoken word for word before the agent says anything of its own. In English (the only call language in v1):
| Call | Opening words |
|---|---|
| Outbound | "Hi, this is {agent name} calling from {company name}. I’m their virtual AI assistant. This call is transcribed and may be recorded. If you would rather not get these calls, just say stop calling and we will not call you again." Then your greeting. |
| Inbound | "Hi, this is {agent name} at {company name}, their virtual AI assistant. How can I help? This call is transcribed and may be recorded." Then your greeting. |
- No setting, API field or custom prompt can remove or change these lines. Your greeting is always added after them.
- If someone asks whether they are talking to a person, the agent says plainly that it is an AI assistant.
- The line names your business (or your agency client), never Avoonta.
Recording and transcripts
- Every call is transcribed. Calls may also be recorded; the notice above is spoken at the start of every call.
- Recording begins only after the person first speaks, so they have heard the notice.
- If the person objects, the agent stops the recording and carries on.
- Some states require every party to agree to recording. The notice is designed for that, but check your own obligations if you call such states.
- Recordings and transcripts are personal data. Protect the copies you download.
Calling hours
We dial, retry and text only between 8am and 8pm in the lead's local time, judged from the area code. This is stricter than the federal rule because some states end at 8pm. We do not skip weekends or public holidays; if a rule that applies to you does, do not send orders on those days. Details: Calling hours.
Do-not-call requests
- When a lead says "stop calling" on a call, or replies STOP to a text, the number goes on your workspace's do-not-contact list for calls and texts. We will not call or text it again, and new orders for it get
409 do_not_contact. - Every fallback text ends with "Reply STOP to opt out."
- Your part: when you get
409 do_not_contact, mark the contact as do-not-call in your own systems too. Do not try to reach the person another way through Avoonta. - Your part: if a person asks you (by email, on your site, in person) not to be called, stop sending them to Avoonta. Coming soon An API to add such numbers to the Avoonta list.
- Consent to be called is not an exemption from every list in every case. Check how the national and state do-not-call registries apply to your leads.
Texts
- A fallback text is sent only from a number registered for business texting, within calling hours, to a number not on the list, and at most once per order.
- Turn texts off for an order with
"cadence": { "send_sms_on_voicemail": false }if your consent does not cover texts.
Where we call
v1 calls US numbers only. Other countries have different consent, calling-hour and disclosure laws and are not supported.
